Welcome to the Brand 'n' Deliver terms and conditions, which apply to all items ordered through Brand 'n' Deliver. Please read these prior to placing your order. These terms and conditions apply to all orders and supersede all others. By placing an order with Brand 'n' Deliver, you accept that Brand 'n' Deliver's conditions are the only conditions that apply to the contract. Please also read Brand 'n' Deliver's privacy policy regarding personal information provided by you.

1. Payment Terms
Online payment - Payment must be made by credit card or debit card or by PayPal at the time of placing an order with Brand 'n' Deliver. Payment in full will be taken at this time and the contract will be in force. Credit account - Universities and government departments qualifying for account status will be required to pay in full within 30 days of receipt of invoice. If for any reason payment is not received as per the above terms, Brand 'n' Deliver reserve the right to rescind credit account status from the client.

2. Passing of title and risk
The risk of the goods shall pass to the client on delivery. All goods, delivered or not, remain Brand 'n' Deliver's property until payment is received in full. Until such time as payment in full is made, you shall retain such goods separately from other goods and clearly mark them in such a way that they can be readily identified as being Brand 'n' Deliver's property and any payment received by you for any sale of such goods must be held in a separate account in trust for Brand 'n' Deliver. In the event of non-payment by the client for such goods, Brand 'n' Deliver will, without loss of any rights or remedy, remove from your possession those goods belonging to Brand 'n' Deliver in accordance with these terms and conditions and Brand 'n' Deliver shall be entitled to access the property where the goods are stored and repossess and remove the same. The client hereby grant Brand 'n' Deliver irrevocable licence to enter your premises for the said purpose.

3. Products
Brand 'n' Deliver reserve the right to alter any details or design of products illustrated without prior notice and while every effort is made to describe goods accurately on sales literature, email and the website, no warranty is given as to accuracy and no responsibility will be accepted for error or mis-description and any resulting loss. Each product where applicable has a minimum quantity for ordering. Brand 'n' Deliver is unable to provide these products in a quantity lower than detailed. Whilst Brand 'n' Deliver display guide quantities based upon price breaks, users may select quantities outside of these pre-set options on the understanding that the price per unit will be determined by the price break below their chosen quantity.
Brand 'n' Deliver makes every attempt to accurately show available products on the website, however due to periods of high demand, certain products or colour variations may become unavailable. Stock is reserved at the point of order confirmation via email. In the event that stock is unavailable, Brand 'n' Deliver will contact you to make arrangements which could include, product substitution or a full refund.
Stock allocation issues may arise in the rare event that two orders for the same product are placed simultaneously, whereby one customer is further down the purchasing procedure than the other.

4. Ordering and contracts
At the time of placing the order and making the relevant payment, no price alterations will occur thereafter to affect the contract. Brand 'n' Deliver reserve the right at any time prior to placing the order to alter its pricing for whatever reason. Brand 'n' Deliver asserts that any items placed in the client's basket without purchase may be subject to price changes. Brand 'n' Deliver will ensure that these alterations are visible. In the event of the client reordering, prices may be subject to variation from those detailed on previous orders.
Any order submitted to Brand 'n' Deliver by the client shall not be treated as having been accepted by Brand 'n' Deliver and accordingly no binding contract shall exist for supply of the relevant products until the client has received written order confirmation from Brand 'n' Deliver.
Clients accept that when re-ordering an engraved product, the imprinting results may vary in colour slightly from the original batch supplied by Brand 'n' Deliver.

5. Prices
All prices shown on Brand 'n' Deliver are not inclusive of VAT, delivery or set-up costs where applicable. VAT will be added at the checkout along with other delivery and set-up costs.
We reserve the right to alter product prices on the website without notice error & omissions excepted.
Where an individual unit price is shown on the product or customisation page, the figure illustrated is for guide purposes only. Exact prices taking into account bulk quantities, set up, technical requirements etc can be found prior to purchase on the basket page.

6. Delivery and lead times
Every effort will be made to deliver on time, but any delivery day or lead-time specified is a best estimate and no liability is accepted for any loss arising from delay or error in the delivery of the goods. Due to variable production workloads, deliveries may be processed ahead of schedule. Brand 'n' Deliver reserve the right to assess and complete orders ahead of the published delivery date and cannot be held responsible for any consequential losses that the client may accrue.
Where delivery charges are applicable, these will be charged at the rates advertised on the website. Lead times will be deemed to commence at the date and time that Brand 'n' Deliver receive the client's upfront online payment. In the case of credit account holders (Universities and Government departments), lead times will be deemed to commence at the date and time the order paperwork is received together with the relevant order number. The client must accept that where there is a delay in order paperwork being received this may alter the lead time and delivery estimates.
Please note, delivery date estimates published on the website are refreshed at mid-day (12pm GMT). On rare occasions where orders and payments are placed by the client seconds prior to the deadline, this could result in the order moving to the next 24 hour delivery slot.
Brand 'n' Deliver ship to the UK mainland only, excluding the Scottish Highlands. Unfortunately we are unable to deliver outside this area.
The client agrees that the delivery address and details they provide at the point of placing the order are correct and instruct Brand 'n' Deliver to use this information to process the order. Any losses that may occur due to incorrect information inputted by the client at the time of placing the order are the sole responsibility of the client. Brand 'n' Deliver recommend clients to keep a copy of all order paperwork for their records.
Working hours - Brand 'n' Deliver is available to take orders 365 days a year. Brand 'n' Deliver's contracted supply partners will operate their production processes within business hours and within relevant EU working time directives in relation to weekends and bank holidays. For this reason Brand 'n' Deliver publishes delivery estimates at the time of ordering, taking the aforementioned into consideration.

7. Quantity variations
Brand 'n' Deliver will be deemed to have fulfilled the contract by delivering a quantity within 5% plus or minus of the quantity of printed goods ordered. The client will be charged at the contract rate for the quantity delivered over the stipulated amount.

8. Claims
All claims must be made via Brand 'n' Deliver's Help Centre within 5 working days of the delivery date.
The client must examine all goods delivered at the time of delivery and confirm receipt. Brand 'n' Deliver shall not be liable for any loss or damage caused to the goods in transit unless loss or damage is noted at the time of delivery via the Help Centre. Claims in respect of non-delivery must be made via the Help Centre within 4 working days from published delivery date.

9. Liability
In all circumstances, Brand 'n' Deliver's maximum liability is limited to the purchase price of the products sold. Brand 'n' Deliver will not, under any circumstances, be held liable for any claim or action that exceeds this liability limit. Brand 'n' Deliver will not be liable for any third party claims for damages against the customer, nor for malfunction of product, cause of delays, interruption of service, or loss of business.

10. Cancellation charges
The client accepts that because of the immediacy of the production process, it is not feasible to cancel any order placed after they have received order confirmation. It is likely that the production process will begin straight after the payment has been accepted. Thus, cancellations will not be considered after the client has given the OK to commence the order.

11. Samples
Samples of many products shown on Brand 'n' Deliver are available upon request. The client must have an account and use the 'sample request' feature on the product page. Samples will be added to the shopping basket and charged at the rate stated + delivery - payable upfront via the online payment system only. No returns will be accepted for samples.
All samples provided will be unbranded and shall be for indication purposes only. The characteristics of products to be delivered may differ from the sample received.

12. Artwork and printing
By uploading artwork, the client authorises Brand 'n' Deliver and its affiliates to retain said logo (artwork) and information for the purposes of providing a tailored experience in future communications. Any artwork uploaded by the client may be used for remarketing and communication purposes. Whilst clients have the option to delete artwork from their account, Brand 'n' Deliver reserves the right to retain and use these artworks exclusively to market with said client only. All artwork and logos are stored securely and will be accessed by Brand 'n' Deliver and their print affiliates only.
By uploading artwork to Brand 'n' Deliver, the client confirms ownership of the copyright and gives permission to use this artwork for imprinting. Brand 'n' Deliver reserves the right to refuse artwork deemed offensive, inflammatory or pornographic in nature (see copyrights and trademarks).
When reordering a product, due to the nature of the production process, Brand 'n' Deliver cannot be held accountable for variations in the colour or quality of said embellishment compared to the previous order.
All artworks saved in the draft format will be stored for 1 month from the date they were created. After this time, unvisited drafts may be deleted.

13. Changes to artwork
The client agrees that the artwork approved at the point of adding to basket is correct and is to be printed on their chosen product/s. Brand 'n' Deliver cannot be held responsible for any errors or omissions at this stage. Whilst Brand 'n' Deliver takes every care to reproduce the imprint as shown on screen, small changes may be necessary due to print processes or product materials.
On occasions where the client is presented with an alternative or additional product via a pop-up modal window on the website, the client agrees through the process of ticking the approval box, that the artwork on the product previously specified before the modal stage will be used for production.

14. Artwork Reproduction & Client Responsibility
Brand 'n' Deliver will print the client's artwork exactly as specified within the print guides provided on every customisation page. Brand 'n' Deliver have ensured that the print guides shown are to scale pro-rata to the size of the product shown on screen.
Clients are advised to utilise as much of the available print area as possible, dependant on logo design and layout. Upon completion of the artwork and approval therein, the client takes full responsibility for their artworks and the final look of the product.
In instances where the client has a grievance that their artwork is printed too small, Brand 'n' Deliver cannot be held responsible for artwork the client creates where it fails to fully utilise the available print area.
The client should note that all print areas stated on the website are subject to change due to improvements and alterations in the imprint process. Whilst every effort is made to accurately reflect the correct print area, alterations and adjustments may need to be made and this in turn may affect delivery estimates. Brand 'n' Deliver reserves the right to alter print areas before, during or after a user has purchased and will endeavour to inform the client if such a change occurs or is necessary.
In instances where the client has provided a logo or design requiring SVG conversion, Brand 'n' Deliver will endeavour to replicate the artwork as closely as possible to the original file. Due to the conversion process, distortions to the graphics may occur. When this happens, it is implicit on the client to communicate with Brand 'n' Deliver's customisation management who will correct any problem identified by the client where possible. If a distortion has occurred, and progresses through to the customisation and imprinting processes unnoticed by the client, this will not be the responsibility of Brand 'n' Deliver. Once the artwork has been approved by the client and payment made, Brand 'n' Deliver will print exactly the graphics approved by the client and no returns will be accepted for unreported distortions. Equally, no consequential loss will be entered into by Brand 'n' Deliver.
The same holds true when Brand 'n' Deliver creates artwork on behalf of the client based on information supplied. Brand 'n' Deliver will endeavour to ensure the information supplied is translated into artwork without error, however, Brand 'n' Deliver will not be held responsible if a mistake occurs.
If the client adds text at the customisation stage (e.g. the client types in their website URL), or specifies a professional colour reference, the responsibility for ensuring this information is correct rests solely with the client. Any information added as text form will be identified in the shopping cart to make double checking easier for the client.
The client is responsible for identifying any errors at the customisation stage and must either make the necessary changes themselves, or inform Brand 'n' Deliver prior to placing an order. At that stage, Brand 'n' Deliver, will make the appropriate changes at its cost. If an error continues to the printing stage undetected, Brand 'n' Deliver will not provide any refunds or re-prints for products printed after artwork has been signed off by the customer. Similarly, Brand 'n' Deliver will not be held responsible for any consequential loss as a result of incorrect artwork being approved by the customer.

15. Complimentary Design Review Service
The complimentary design review service offered by Brand 'n' Deliver ensures the eligibility of artwork for the print process regarding file integrity and technical tolerances but nothing more. Any customer error relating to text fields, alignment, spellings, spacings or numbers etc previously approved by the client on the customiser page will not be the responsibility of Brand 'n' Deliver. To be clear, the products will be printed as close as possible to the design created by the client.

16. Colour variations
Due to the variety of materials and the imprinting processes utilised by Brand 'n' Deliver and its supply partners, no guarantee can be given to match exact colour references or colour samples provided by the client. Brand 'n' Deliver will endeavour to match as closely as is technically possible to these colour references but cannot be held responsible for any further costs that may arise due to slight colour inconsistencies.

17. Force majeure
Brand 'n' Deliver will not be held responsible for failure or delay in the carrying out of its obligations under the contract arising out of any cause outside its reasonable control or by inability to procure materials or articles except at higher prices due to any such cause. In such circumstances Brand 'n' Deliver shall be entitled to terminate the contract in whole or in part without incurring any liability to the client.

18. Copyrights & Trademarks
By submitting a design or artwork to Brand 'n' Deliver, the client warrants and represents that they are the sole, legal owner or licensee of all rights, including copyright, to each copyright, trademark, service mark, trade name, logo, statement, portrait, graphic, artwork, photograph, picture or illustration of any person or any other intellectual property included in such design.
Further, the client warrants and represents that no part of the design: (1) violates or infringes upon any common law or statutory right of any person or entity, including, but not limited to, rights relating to copyrights, trademarks, contract rights, moral rights or rights of public performance; (2) is the subject of any notice of such infringement the client has received; or (3) is subject to any restriction or right of any kind or nature whatsoever which would prevent Brand 'n' Deliver from legally reproducing the images, graphics or text supplied.
The client agrees to defend, at their sole expense, any claim, suit, or proceeding brought against Brand 'n' Deliver which relates to, or is based upon, a claim that any portion of the design infringes or constitutes wrongful use of any copyright, trademark, or other right of any third party, provided that Brand 'n' Deliver gives the client written notice of any such claim and provides the client such reasonable cooperation and assistance as the client may require in the defense thereof. The client shall pay any damages and costs assessed against Brand 'n' Deliver pursuant to such a suit or proceeding. Further, the client agrees to indemnify and hold Brand 'n' Deliver harmless from and with respect to any such loss or damage (including, but not limited to, reasonable legal' fees and costs) associated with any such claim, suit or proceeding.
All items shown on this website featuring corporate logos or registered trademarks are shown only to illustrate Brand 'n' Deliver logo and print reproduction capabilities. Purchase of merchandise from Brand 'n' Deliver in no way, shape or form grants the client permission to reproduce logos, nor does it transfer, grant or lease ownership of any logos or trademarks to the client or any third party.

19. Quality Policy
All of Brand 'n' Delivers products are sourced exclusively by selected and trusted suppliers based in Europe and thus comply with applicable EU quality and safety regulations. A declaration of conformity is available for all products upon request. Further information regarding product and print specifications can be found on the product pages.
Brand 'n' Deliver is an equal opportunity employer operating stringent policies of non-discrimination. Brand 'n' Deliver appoints 3rd party supply partners that conform to these same ethical standards.

20. Returns Policy
Client satisfaction is very important to Brand 'n' Deliver. Clients should contact the Brand 'n' Deliver Help Centre immediately if there is an issue relating to an order. A Brand 'n' Deliver customer service agent will make personal contact you as soon as possible.
The client should describe the issue in detail including pictures to support the query. Brand 'n' Deliver reserves the right to refuse returns.
Returns policy applies to blank orders only. Printed items are not eligible for returns unless the item is faulty or the embellishment is defective. Upon reviewing and accepting the client's claim, a full or partial refund may or may not be processed on returned goods.
Brand 'n' Deliver's customisation management will decide if a product imprint falls below acceptable commercial tolerances.

21. Garment Sizing and Clothing Returns Policy
Due to the varying nature of manufacturing techniques and materials, clothing sizes may vary slightly from product to product. As a consequence of this, Brand 'n' Deliver recommend clients to refer to the size guide in the product description when entering desired sizes & quantities. As garments will be personalised, Brand 'n' Deliver cannot accept any returns due to mis-sizing.

Brand 'n' Deliver reserve the right to change, modify, or amend these terms and conditions at any time. Please review Brand 'n' Deliver terms and conditions periodically for any changes. Use of this website after any modification implies your consent to these terms and conditions as modified.
